Sprint Assisting Smaller Carriers to Fight Verizon's and AT&T's Tyranny

The third largest U.S. carrier Sprint (S) is desperate to get a bigger share of the wireless market. Softbank CEO Masayoshi Son, who decided to enter the U.S. wireless market last year by acquiring majority stake in Sprint, is building various strategies to uproot the tyranny of Verizon (VZ) and AT&T (T). The Kansas player is assisting rural carriers by offering them access to the company's spectrum, while they improve their own network. What's the purpose? What's it that Sprint's expecting to gain through this move? Let's try and unearth…

Delving deep

The U.S. telecom is by and large dominated by Verizon and AT&T, while Sprint and T-Mobile (TMUS) are distant competitors; thanks to their size. Son understands it quite well that Sprint, in isolation, stands little chance to challenge the likes of the top two. It's only when it would combine with T-Mobile and win the confidence of others that the company would be able to fight the larger rivals.

The company's entered into an agreement with Competitive Carriers Association (CAA), representing tiny mobile operators, through which smaller mobile providers would be able to utilize Sprint's nationwide network until they build their own. On the other hand, Sprint customers would be able to use the better network of smaller players. At the trade show in San Antonio Son said that the program's aimed at providing high-speed internet service to areas which were devoid of it. This would intensify competition in the market.

By aiding rural carriers in their network spending, Sprint is trying to build support and create a lobby that would endorse the telecom major's combination with T-Mobile. Son believes that it's time to raise resources, concluding his presentation by saying "Let's fight back!"

Combination solution to end tyranny

Sprint is bent on joining forces with the fourth largest carrier. However, the government officials don't look that excited about the proposal. The FCC and the U.S. Department of Justice's antitrust division are very cynical about the implications of the prospective merger. In an ideal wireless market there should be four national carriers, and a combination would reduce the number of players to three. But Son puts this in a different way.

He says that the merger would boost competition in the duopoly market. Son is so ambitious to increase Sprint's competitive strength that it's ready to defer profits for the time being as it's pouring in billion to deploy a strong network. The company is keen on increasing its market share to such an extent that it's ready to offer service at price cut level.

Whether or not the FCC would agree to the merger proposal remains a question. A few years back the FCC and the Department of Justice turned down AT&T's proposal to acquire T-Mobile in a $39 billion deal, which clearly shows that the regulators dislike sanctioning big deals that threaten competition.

Parting thought

Although the regulators are acting like a roadblock on the way, there's no stopping Son. He is trying various ways to convince the regulators that the merger is for the betterment for the industry as a whole. The fate of the deal is unknown, but in case it's successful, both Verizon and AT&T would have a good run for their money.

The FCC, to best perform its fiduciary relationship to the American consumer, wants to increase competition. What better way to do this than to allow a company to be created that can effectively compete against the current duopoly of VZ and T? The FCC would also increase competition by making sure a combined Sprint/TMUS gets a share of low frequency spectrum that would put their holdings in proportion to VZ and T.

BlackBerry Goes Green Thanks To Smaller Than Anticipated Loss

Not long ago BlackBerry was all but left for dead. Shares shed 36.5% in value last year with many believing the best the former smartphone king could hope for was to be sold for parts. The company's financial situation still isn't pretty, but shares are up more than 18% so far in 2014. And the stock's post-earnings pop Friday shows new hope among investors.

For the fourth quarter, BlackBerry reported $976 million in revenue, down 64% from the same period during the prior year. Services made up 56% of the phone maker's sales, 37% came from hardware and 7% came from software. The company reported a $423 million net loss, or an 80 cent loss per share.

Despite the steep loss, shares popped at one point more than 4% to $9.43 in pre-market trading thanks to a lighter than anticipated non-GAAP loss per share. Wall Street analysts were expecting a non-GAAP loss of 55 cents per share, but excluding several one time charges the company reported just an 8 cent non-GAAP loss.

"I am very pleased with our progress and execution in fiscal Q4 against the strategy we laid out three months ago. We have significantly streamlined operations, allowing us to reach our expense reduction target one quarter ahead of schedule," said CEO John Chen in a statement. "BlackBerry is on sounder financial footing today with a path to returning to growth and profitability."

For the full fiscal 2014 year, BlackBerry reported $6.8 billion in revenue, down from $11.1 billion in the year prior. On a GAAP basis the company had a $5.9 billion net loss, or $11.18 per share.

Looking ahead the company simply noted that it "anticipates maintaining its strong cash position and continuing to look for opportunities to streamline operations. The Company is targeting break even cash flow results by the end of fiscal 2015." In the fourth quarter BlackBerry used $553 million in cash flow for operations, and $243 million investing activities. As of March 1, 2014 the company has $1.6 billion in cash and cash equivalents.

SAC Capital "deeply remorseful" for misconduct

NEW YORK — Attorneys for SAC Capital are urging a federal judge to accept the hedge fund giant's guilty plea in a record-setting $1.8 billion insider trading case.

The hedge fund and its affiliates, headed by billionaire Steven Cohen, "are deeply remorseful for the misconduct of each of the individuals who broke the law while employed by them," attorney Martin Klotz wrote in a sentencing memorandum to U.S. District Court Judge Laura Taylor Swain that was filed Thursday.

Klotz stressed that the plea agreement reached last November includes a $900 million fine that exceeds federal sentencing guidelines and requires SAC Capital and the affiliates to permanently cease all investing for outside clients.

"There can be no doubt that these and other penalties send a strong public message about the costs of the conduct that have brought the defendants before Your Honor," wrote Klotz. "The defendants respectfully request that this court approve the plea agreement and impose the sentence it provides."

Cohen is now winding down his once-mammoth hedge fund, converting the operations to a family office that will be limited to managing his own investments and fortune, along with trading for his employees.

The criminal case focused on evidence that SAC Capital leaders created a culture that fostered widespread insider trading by employees. Evidence amassed by federal prosecutors showed the trading was based on non-public information about companies that included pharmaceutical firm Elan, microchip makers Intel and Advanced Micro Devices and information and communication firms Yahoo and Blackberry.

In announcing the plea agreement, Manhattan U.S. Attorney Preet Bharara and other Department of Justice officials said the $1.8 billion penalty was believed to be "the largest financial penalty in history for insider trading offenses."

Taylor Swain, however, indicated in November she wanted time to review details of the plea deal and surrounding issues before deciding whether to acce! pt it. In part, the delay was based on the then-pending insider-trading trials of former SAC traders Mathew Martoma and Michael Steinberg. Both have since been convicted.

SAC Capital's sentencing hearing is set for April 10. Although federal prosecutors and defense lawyers have endorsed the plea agreement, the authors of two emails submitted to Taylor Swain urged her to reject the deal and require the government to pursue tougher penalties against the hedge fund and its founder.

Cohen, among the world's wealthiest individuals, faces a separate Securities and Exchange Commission administrative proceeding on civil allegations that he failed to properly supervise subordinates who became involved with criminal insider trading at the hedge fund.

That case has been stayed pending the criminal case sentencing. Citing unidentified sources, CNBC reported Tuesday that Cohen may seek a settlement to resolve the SEC allegations.

Too Early for Profits, But Not Forever

Despite the fact that profitability may be a long way off for this cloud storage company, MoneyShow's Jim Jubak thinks it is too early to simply dismiss the company as just another sign of another Internet bubble.

The timing could be better.

News that Box, a cloud storage company, is looking to raise $250 million in an April initial public offering, broke the same day (yesterday, March 25) that Google (GOOG) announced that it was reducing the price for its cloud services by 30% to 85%.

Hard to see how Box, which was valued at $2 billion in its last round of venture capital, could possibly be worth the $3 billion to $5 billion post-IPO figure that's being thrown around Wall Street. Especially because Box's filing with the Securities & Exchange Commission, released yesterday, makes it clear that this company is a long, long way from seeing any profits. Sales climbed to $124 million in the fiscal year that ended in January 2013, from $59 million in fiscal year that ended in January 2012. But net losses in the same period climbed to $168 million from $112 million.

In its prospectus, Box says it does not expect to be profitable "for the foreseeable future."

Sure plays into the current cynicism about profitless tech companies and market bubbles, right?

I'm not willing, however, to dismiss Box (which will trade under the ticker BOX after it goes public) as just another sign of another Internet bubble in the current market. The problem with valuing the company is that the cloud market is real and growing fast, but that it hasn't yet shaken down into clear segments with winners and losers (and clear criteria for what distinguishes a winner from a loser).

Consider this post more an attempt to sketch in what those criteria might be, than a rave or pan on Box and its IPO.

The public cloud market—the one you probably use yourself to storage photos or share documents—is forecast to grow to $31.4 billion in 2017, from $6.2 billion in 2012. That's a compounded annual growth rate of 38.3%.

This is the part of the cloud market where Google competes—and where Google cuts prices. The public cloud sector is dominated by Amazon.com (AMZN) with Microsoft (MSFT), Google, IBM (IBM), and Rackspace Hosting (RAX) competing for the Number Two slot.

But the public cloud, as you know it, isn't where the action is.

The big growth in the coming decade will come as cloud companies penetrate the business market. Selling into that market is a very different proposition from running ads on the Internet to reach consumers. And the question of who can come up with the killer competitive advantage in the business market is still very much an open question. That's why the Box IPO marks only the beginning of a wave of cloud IPOs. Next name up that you may have heard of is likely to be Dropbox.

USEC Inc. (USEC) is a global energy company, is a supplier of low enriched uranium (LEU) for commercial nuclear power plants. The Company operates in two segments: the low enriched uranium (LEU) segment with two components, separative work units (SWU) and uranium, and the contract services segment. The LEU segment is its primary business focus and includes sales of the SWU component of LEU, sales of both SWU and uranium components of LEU, and sales of uranium. Another day, another all-time record close for the S&P 500 Index (SNPINDEX: ^GSPC  ) . But, really, it's nothing new. Tuesday was the fourth straight day the S&P set new records, as it rose 8.5 points, or 0.5%, to close at 1,625. Even as most stocks were busy defying gravity, three major underperformers still left their distinctive stains on the 500 stock index.

First Solar (NASDAQ: FSLR  ) was a victim of its own quarterly results, losing 8.9% after sales came in higher than expected but earnings disappointed. It seems the market may simply be acknowledging how fully priced the organic Mexican food restaurant company's stock is. Of the five investment houses that changed their price targets for Chipotle in April, two of them rated the stock a buy. Yet the highest price target of the five only represents an 8% upside from today's levels.

    Grin and bear it
    Darden did its best to put a bright face on the numbers. CEO Clarence Otis took pains to point out that at least Darden's same-restaurant sales are growing, and "well above industry average" this quarter. He's right about that. If Darden's sales look weak this week, then the numbers coming out of rivals Bloomin' Brands (NASDAQ: BLMN  ) and Brinker (NYSE: EAT  ) -- growth of just 3.5% and 0.1%, respectively -- are downright depressing.

Brinker International reported almost a 15% restaurant operating profit margin last quarter. It would add around $1 million to the bottom line by carving 2.7% off the top. It would also add around $0.14 in EPS, a 67% increase over last quarter. 3 Things You Need to Know to Get the Child Care Tax Credit

But the Internal Revenue Service helps millions of Americans by offering a credit to offset some of your child-care expenses in order to help you work. Here are three things you need to know to claim the Child and Dependent Care Credit on your tax return. How to Qualify for the Child and Dependent Care Credit The rules are structured to make the credit available only in situations where the care is needed in order to help the claiming parent or parents work or look for work. For joint filers, both parents must have earned income from wages, salaries or other compensation, including self-employment. Full-time students are also treated as having earned income for purposes of claiming the credit. Moreover, the care must be directly connected to allowing you to work, rather than off-hours babysitting for personal reasons. This requirement leads to some important distinctions, with one example being that the cost of summer day camps qualifies for the credit, but overnight camps don't. In most cases, children must be age 12 or younger to qualify for the credit. Certain exceptions exist for other individuals who aren't able to care for themselves. The credit also has a number of technical rules. For instance, in cases involving divorce, the custodial parent can take the credit, while noncustodial parents can't, even if they would otherwise qualify to treat the child as a dependent. How Much the Credit Can Pay You The amount of the credit depends on two things: the number of qualifying children you have and your gross income. Those with one qualifying child can claim up to $3,000 per year toward determining the credit amount, while those with two or more qualifying children have a $6,000 annual limit. Calculating the credit requires taking your actual expenses or the maximum limit, whichever is less. For those with incomes of $15,000 or less, the credit is 35 percent of the child-care expenses, which comes out to a maximum of $1,050 for those with one qualifying child or $2,100 for those with two or more qualifying children. Above $15,000, the credit drops by 1 percentage point for every $2,000 of extra income, hitting a minimum of 20 percent for those who earn $43,000 or more in adjusted gross income. In addition, if you get partial reimbursement of expenses from a state agency or other source, then you're not entitled to take the credit on the reimbursed amount. Instead, you have to deduct the reimbursement and calculate the credit based on the net amount that you paid. What Documentation You Should Get to Claim the Credit In order to claim the credit, you need to fill out IRS Form 2441. On the form, you'll need to provide the name, address and Social Security number or Employer Identification Number of the provider. By doing so, the IRS can match your claim against the records that some child-care organizations are required to provide. It can also check to make sure that whoever you pay to provide child-care services reports those payments as income and pays taxes. There's one exception for having to provide an Employer Identification Number. If a tax-exempt organization provides the care for your child, then you only need to write in "tax-exempt" in the box on Form 2441 that asks for an EIN. StoneMor Partners L.P. Q4 Loss Narrows; Revenue Rises (STON)

On Friday, cemetery operator StoneMor Partners L.P. (STON) reported that its net loss for the fourth quarter narrowed from last year, aided by a 6.4% rise in revenue.STON’s Earnings in Brief

STON reported a Q4 net loss of $3.5 million, compared to a loss of $3.9 million a year ago. Revenue was $63.1 million, up from $59.3 million last year. For FY2013, the company reported a net loss of $19.0 million, compared to a loss of $3.0 million in 2012.  The large loss in 2013 was primarily due to costs related to the early retirement of senior notes. Revenue for the year rose to $246.6 million in 2013, from $242.6 million in 2012.

CEO Commentary

Lawrence Miller, President and CEO of STON commented: “StoneMor closed the year with a solid fourth quarter, showing improvement over the fourth quarter of 2012 in nearly every category,” s

“GAAP revenues and operating income in the fourth quarter of 2013 both improved over the fourth quarter of last year, while such non-GAAP financial measures as production based revenue and adjusted operating profits showed very strong growth, up 17.4% and 73.1% respectively. Driving much of this performance has been the ongoing contributions from acquisitions made in 2012 and 2013. The contributions from acquisitions also helped power a 75.9% increase in our distributable cash flow (non-GAAP) compared to the fourth quarter of 2012.

STON’s Dividend

STON paid its last 60 cent quarterly dividend on February 14. We expect the company to announce its next dividend in April.

 Stock Performance 

StoneMor Partners shares were mostly flat during premarket trading Friday. The stock is down 3.8% YTD.

Is Costco a Good Buy Right Now?

Costco's (NASDAQ: COST  ) performance this year has been patchy with shares down 5%. The company's second-quarter numbers slightly missed consensus expectations as heavy discounting during the holiday period ate into its margins. Weak sales, deflation in gas prices, and forex fluctuations also affected its second-quarter results. Moreover, with competition rising from big box retailers such as Wal-Mart (NYSE: WMT  ) and competitive pricing from dollar stores such as Dollar General (NYSE: DG  ) , is the membership warehouse retailer in for troubled times ahead?

In trouble
There are a number of factors why Costco is feeling the heat. Forex fluctuations have negatively affected its revenue from international operations. Also, bad weather conditions, which affected many retailers last quarter, also damaged Costco's performance. Its sales were hurt by club closures across the United States, Canada, and even in Japan because of snowstorms.  It also had to close its store in Mexico after a hurricane.

Another reason behind Costco's declining profits is the deep discounts it gave during the holiday season. As a result, profit fell 15%. But, as analysts at Nomura point out, "Costco's consistent low-mid-single-digit traffic gains over the last year in spite of the challenging retail environment were particularly encouraging. We continue to believe the fundamentals of the company are intact."

Some positives
Costco has some reasons to cheer as new memberships increased 13% in the second quarter, following the opening of new stores in Japan and Australia. Costco's executive membership base has also been rising at a good pace, and this will be profitable in the long run since executive members, which represent 38% of all members, spend more than their non executive brethren.

As far as expansion is concerned, Costco opened warehouses at 16 new locations by the end of the second quarter. Looking forward, it has plans to open an additional 14 stores before the end of this fiscal year. The expansion will be carried across the U.S., Canada, Japan, Korea, the U.K., and Australia. Costco plans to open its first store in Spain this year and end the fiscal period with 30 new openings. Given that Costco's new warehouses have fueled its growth in recent times, these new openings should enhance investors' confidence going forward.

Outperforming Sam's Club
Also, Costco has pioneered the warehouse club retail model, which relies on bargaining power, supply chain efficiencies, and smaller markups on branded products, giving it an edge over the likes of Wal-Mart. Also, Costco generated about $162 million per club in the last fiscal year, compared with $80 million per unit at Wal-Mart's Sam's Club. Costco's product assortment and services, along with a friendlier and a better store layout as compared to Sam's Club are some of the factors that make it click with customers.  

Even though Wal-Mart's Sam's Club offers various services such as free flat-tire repair, car battery testing and wiper blade installation, Costco's ancillary business has also been growing well. This segment includes various services such as food courts, photo centers, gas stations, etc., and accounts for around 20% of overall revenue. The ancillary segment's revenue has increased at a faster rate than store revenue because Costco is attracting new customers with the help of its ancillary units using its so called "loss leader strategy."  

In this strategy, a product is sold at or below cost to get customers into the shop. But, this will be beneficial only if they buy other things from its retail department, so success is not guaranteed here.

But what about this potential threat
Also, potential competition cannot be ruled out from dollar stores such as Dollar General. Although Dollar General follows a different format, and is not a warehouse club like Costco, its low pricing could turn out to be a threat. Last year, according to a Kantar Retail price survey, Dollar General's total basket was the cheapest among the retailers surveyed. With everyday low prices and a huge network of stores that exceeds 11,000, the point that Dollar General could be a threat cannot be ignored. Moreover, Dollar General opens 600-700 locations a year, signifying the rapid pace at which it is expanding its reach. 

Takeaway
Costco's new stores seem to be performing well, but the company needs to get its act together after a weak quarter last time. It will continue to expand internationally, but at a trailing P/E ratio of 25, I think that it is too expensive to jump in right now. So, investors should wait on the sidelines for a more attractive share price.

    Today's big gainer among the Dow stocks was Caterpillar Inc. (NYSE: CAT). Competitor Joy Global Inc. (NYSE: JOY) reported rotten results this morning, largely due to anemic sales to coal miners. Caterpillar doesn't do a lot of business with coal companies, so that's a plus the firm. Cat's shares traded up 1.4% at $97.71 in a 52-week range of $84.79 to $98.24 just ahead of the closing bell. Volume is on track to be about 25% below the daily average of around 6 million shares traded.

FOMC Outlook Watch: More Tapering AND Slower Growth in 2014

The Federal Reserve’s Federal Open Market Committee has another meeting this week regarding U.S. interest rate policy. While no new rate announcement is expected to come, what is expected is the announcement of more tapering — some $10 billion by our take.

Janet Yellen and other Fed presidents have said on many occasions that they are comfortable with the $10 billion incremental notch in monthly bond buying. Most likely that will take place with another $5 billion less in Treasury buying and another $5 billion less in mortgage backed securities.

Investors also will need to remember that this is a two-day meeting, starting on Tuesday morning and ending with the formal announcement (statement) around 2:00 p.m. EST on Wednesday.

We will be watching for changes in how the Fed’s characterization of the economy, as well as changes in guidance, because the quarterly forecasts will be released on Wednesday as well. Look for a slightly lower growth forecast, but one that still allows for the bond tapering to continue.

Madoff jury views 'false remorse' scandal icons

NEW YORK — One day after jurors in the fraud trial of five former Bernard Madoff aides saw the Ponzi scheme mastermind depicted as the evil Joker of Batman movie fame, they were presented with images of four disgraced public figures.

Courtroom video screens displayed pictures of former New York governor Eliot Spitzer, who resigned in 2008 after involvement with prostitutes; ex-New York congressman Anthony Weiner, who stepped down amid a 2011 sexting scandal; televangelist Jimmy Swaggart, humiliated in 1987 by affairs with prostitutes; and current Toronto Mayor Rob Ford, a self-admitted drug user.

Why? To compare their public confessions to the moral transformation former Madoff financial lieutenant Frank DiPascali said prompted him to confess his role in the scam, seek a government cooperation deal and become the star prosecution witness against his former co-workers.

"I think they're all good examples of false remorse," Roland Riopelle, the defense lawyer for longtime Madoff assistant Annette Bongiorno, explained afterward, outside the presence of jurors.

Minutes later, attorney Andrew Frisch mounted the last of five defense closing-argument attacks on DiPascali and Madoff. He characterized them as partners-in-crime who hoodwinked the former staffers into doing tasks that enabled the duo to scam an estimated $20 billion from thousands of investors worldwide.

The arguments came on the eve of final prosecution rebuttal statements in the trial, which began in October and has become what lawyers involved said wa! s one of the longest white-collar crime cases in Manhattan federal court history. Jury deliberations are expected to begin as soon as Friday after final legal instructions from U.S. District Judge Laura Taylor Swain.

The case is the first Madoff-related criminal proceeding to be weighed by a jury. The disgraced financier pleaded guilty without standing trial after the scheme collapsed in December 2008. He's now serving a 150-year prison term.

The trial defendants include ex-Madoff operations manager Daniel Bonventre, former investment financial account manager JoAnn Crupi, and former Madoff computer programmers Jerome O'Hara and George Perez. They face decades-long prison terms if convicted on charges of knowingly participating in and profiting from the fraud.

Frisch, representing Bonventre, argued that the more than 30 witnesses and dozens of exhibits presented to the jury by federal prosecutors provided compelling evidence against Madoff and DiPascali — but not the defendants.

"They're the glue that binds all the pieces together," said Frisch.

He argued that much of the prosecution case rested on other former Madoff staffers who sought cooperation agreements after they were confronted with the prospect of criminal charges. The witnesses, who Frisch said did not incriminate the five defendants during early meetings with investigators, all testified during the trial.

Bonventre "didn't close his eyes or consciously avoid" anything sus! picious, ! said Frisch, who argued "Dan asked questions, and Madoff lied to him."

Instead, he argued Bonventre and the other defendants were unwittingly lulled into believing the lies by his boss' success and the array of celebrities, sports-world executives, financial fund managers and others who entrusted their investments to Madoff.

Bonventre borrowed $1.5 million to buy a New Jersey oceanfront vacation home on Dec. 1, 2008, 10 days before Madoff was arrested, said Frisch.

He argued the transaction was "an odd thing to do" if Bonventre had been "truly in the loop with Madoff and DiPascali in knowing about the scheme and the imminent implosion."

Public investors get no say in new Google

Q: How does Google's split affect investors?

A: Google's upcoming stock split will give its founders even more control of the Internet advertising giant they created.

In a proposal first advanced years ago, owners of Google's class A and class B shares on April 2 will receive a newly created class C. These class C shares give their owners no voting rights whatsoever. These shares, says S&P Dow Jones Indices, will become the primary class of stock for investors to monitor.

The new class of stock will allow Google founders Larry Page and Sergey Brin to maintain their control of the company, even while their ownership stake falls. The company routinely issues new shares of stock to employees, a move that has reduced the founders' stake over time.

These new shares will affect Google investors in several ways. The move makes it very clear the company is being run for and by the founders, not necessarily the public investors, who will have no say in events. The move will also give Google a source of shares that can be freely issued without diluting the founders control.

Savvy investors, though, know that the decision of whether or not to invest is based primarily on valuation. And based on the discounted cash flow model — which forecasts the value of a stock based on expected future cash flow — Google is a hold, not a buy, says NewConstructs.

Q&A: Summers says middle class feels pinch

Larry Summers, Treasury secretary under former president Bill Clinton and President Obama's chief economic adviser during the recession's darkest days, has been tossing cold water lately on generally optimistic economic forecasts. He argues that technological changes have widened the divide between rich and poor and could mean slower economic growth for a long period unless Congress passes another stimulus to increase spending.

USA TODAY economics reporter Paul Davidson spoke Monday with Summers, who was attending the annual economic policy conference of the National Association for Business Economics. Here's what he had to say:

Q. You paint a pretty bleak picture of the economy. Why is that?

A. It doesn't have to be bleak, but demand may be a challenge. I think that changes in the structure of the economy mean reduced demand for investment. It's a much more mass-less economy, a lighter economy where a WhatsApp (purchased by Facebook last week in a deal valued at $19 billion) can be worth more than a Sony.

When start-ups (such as WhatsApp) can be seeded with hundreds of thousand of dollars, it's a positive thing, but it presents challenges. Technology means there's less need for new investment than there was. When more people are shopping on Amazon, there's no need to build malls. When people can teleconference, there's less need for hotels.

It then makes recession more likely. These trends have been underway for some time. The unfortunate fact is it's been a long time since we've observed simultaneous rapid growth, high capacity and (a lack of bubbles, such as in housing or the stock market).

Q. Many economists are looking for stronger growth this year now that consumers have paid off much of their debt, household wealth is rising, and the housing recovery is picking up. Do you disagree?

A. I hope they're right. But the first month and a half have not been that encouraging. I think it's probably more than weather. It looks pretty pervasive across the country,! and the weather hasn't been bad everywhere. I think we may have gotten a little excessively optimistic at the end of last year (because of business stockpiling), and now that needs to be worked off.

Q. How much growth are you forecasting?

A. I suspect in the 2%-2.5% range (for the gross domestic product). I was hoping for more than 3%, but I think that looks like less than a 50/50 shot. We're hoping for acceleration, but unless we can take stronger policy actions to increase confidence, I'm not sure it will happen.

I think there is a set of very important headwinds. I think there's also risk from what happens in emerging markets, risks from what happens in the remainder of the industrialized world.

Q. How do we get out of this rut?

A. It's a combination of measures to promote exports, measures to support private investment and public investment (federal spending). If we simply get ourselves going, it's much easier to keep going than it is to accelerate. What we need is to accelerate right now, and that will then create pressures for employment and investment that tend to make the recovery more self-sustaining.

Q. The conventional wisdom is that technology reduces job growth in the short term but increases it in the long term as productivity leads to higher incomes and spending. Is that no longer the case?

A. Certainly the hope is that increased technology will create new jobs to an extent greater than the number of jobs it displaces, but that's not something that can be taken for granted. And the process of adjustment will take a very long time. I don't think we can count on that.

It may be that given the presence of technology, the productivity in some categories of labor — particularly those that perform routine tasks — will be substantially lower.

Q. You're touching on the much-lamented disappear! ance of m! iddle-wage jobs and the shrinking of the middle-class. What's your view of that?

A. I think what we've seen is a great increase at the top and things have been OK at the low end, but there hasn't been a great increase in the middle.

Q. What can be done about it?

A. I think education has a central role to play. I think the kinds of jobs that would be created by public investment programs would be very much the kinds of jobs that support middle-class standards.

Q. How do you see the problem of income inequality?

A. I think globalization and technological change are raising the rewards to the most entrepreneurial and able among us. But they're pulling away from everyone else. And that creates a real challenge to social cohesion.

Q. What's the solution?

A. Solutions lie in education that empowers everyone. They lie in more progressive taxation (that imposes higher taxes on the wealthy to fund programs that benefit the poor and middle-class).

Q. Would increasing the minimum wage help?

A. I think increasing the minimum wage is constructive. It's not the most fundamental thing.

Q. A Congressional Budget Office report last week concluded that that raising the minimum wage would lift 900,000 Americans out of poverty but also could mean 500,000 fewer jobs. Does that cast doubt on the idea?

A. I think the income-producing benefits for low-income people offset any likely job displacement.

Cliffs Natural Resources v. Casablanca Capital: No End in Sight

In what’s looking like it could be as protracted as the Hundred Years’ War, the battle between Cliffs Natural Resources (CLF) and activist investor Casablanca Capital escalated last night.

Just to refresh: Casablanca has been pushing Cliffs to make some big change, including a possible breakup. And Cliffs has, just not the ones Casablanca wants. It’s appointed a new CEO; cut costs; postponed its expansion of Bloom Lake; it even beat earnings for the fourth consecutive quarter. (I cribbed all that from here.)

Cowen’s Anthony B. Rizzuto and team take it from there:

Activist investor Casablanca laid out its proposal to nominate six directors for election to CLF’s Board. To avoid a potentially costly proxy contest, CLF offered to permit Casablanca to appoint two new directors to the Board and a third mutually agreed upon to be named at a later date. This offer was rejected, and as a result, CLF has postponed its annual meeting as discussions continue. With only a 5.2% stake, we question whether Casablanca alone will be able to accomplish the goals it has laid out.

Shares of Cliffs Natural Resources have fallen 2.7% to $18.59 at today at 3:42 p.m., while Rio Tinto (RIO) has fallen 3.6% to $53.36, BHP Billiton (BHP) has dropped 2.2% to $66.64 and Vale (VALE) has plunged 5% to $13.05.

David Rolfe Comments on Perrigo

During the quarter, Perrigo (PRGO) announced strong September quarter adjusted earnings growth of 20%.  We say "adjusted" because the Company incurred what we believe are non-recurring charges related to the recent purchase of Elan Corporation, which is a branded-drug company domiciled in Ireland.  Upon the closing of this purchase, Perrigo has "re-domiciled" itself in Ireland, with an effective tax rate meaningfully below what they were subjected to in the U.S.  Given that the Company actively pursues a strategy of inorganic growth as much as it pursues organic growth - having acquired six new businesses over the past 18 months (including Elan) - we expect that this new tax structure should make future acquisitions, particularly those U.S. based businesses, much more attractive.  Further, Perrigo's core business, which includes private-label over-the-counter (OTC) pharmaceuticals and infant formula, drove much of the year-over-year growth.  The Company's unrivaled scale in manufacturing and marketing of store-branded offerings continues to enable retailers to mimic the value proposition of OTC pharmaceuticals and infant formula.  This "store-brand conversion" is a multi-year trend that we expect will continue for the foreseeable future as consumers continue to become more value-conscious, yet more comfortable with store-brand quality that Perrigo helps engineer.

Hot Machinery Companies To Own In Right Now

Now that we've gotten through five months of 2013, it's a good time to review which stocks have performed well for the year, which haven't, and whether you should own any of them. With the Dow Jones Industrial Average (DJINDICES: ^DJI  ) having increased by 15.35% year to date, there have clearly been more big winners than big losers this year. With Caterpillar (NYSE: CAT  ) being the biggest Dow loser and down only 4.25% in 2013, and Hewlett-Packard (NYSE: HPQ  ) being the biggest winner, up 71.37% in 2013, the difference is dramatic. But, let's look at why these stocks have performed the way they have, and whether you should own either of them. My conclusion may shock you!

Losers go first
Following top index loser Caterpillar is aluminum giant Alcoa (NYSE: AA  ) , whose shares have fallen 2.07% year to date. The most likely reasons both companies have fallen this year are a struggling economy in Europe and a slowing one in China. Both companies need strong construction and manufacturing in the major world markets, and with all the issues in Europe, construction and development are stuck in the concrete -- which has lowered the need for Caterpillar's heavy machinery and for massive amounts of aluminum building materials.

    In terms of individual companies, there are several good choices, but these can behave very differently. Pan American Silver (NASDAQ: PAAS  ) , for example, missed revenue expectations and beat earnings expectations in its last earnings release. But despite the beat, EPS shrank considerably from a year earlier on a GAAP basis. The stock has been fairly flat ever since. Conversely, First Majestic (NYSE: AG  ) reported strong revenue growth and a small bump in profits, sending the stock higher since the announcement. First Majestic reported increased cash costs and tightening margins, largely driven by lower silver prices. Each of these companies faces pressure from increasing production costs and environmental concerns.

    Okay, I think we're starting to get an idea for what might be the ideal kind of stock for the economy as we're looking at it, and if you look at the analyst state that Cummins—that's symbol (CMI), they're a diesel engine manufacturer—recently held on September 16, you get a sense of what that is. What they said hit a very good chord with Wall Street. You had people raising their target prices by $20 and $30 a share. Cummins trades at $135, so that's not quite as big as if you were talking about a $20 increase on a $50 stock, but still pretty impressive.

    Huh? What?
    I know. That hardly seems to make sense, does it? Oshkosh simply crushed analyst earnings estimates for the quarter, delivering $0.97 per share in profit where only $0.86 were forecast. It added a dime to its full-year forecast as well, predicting that earnings could rise as high as $3.15 by year-end. First-half operating profit margins, at 5.8%, still fall far short of rival armored-vehicle makers Textron (NYSE: TXT  ) and General Dynamics (NYSE: GD  ) . But Oshkosh is now neck-and-neck with heavy-equipment maker Terex (NYSE: TEX  ) , and is simply smoking unprofitable rival MRAP maker Navistar (NYSE: NAV  ) .

The Company also manufactures a range of other types of aluminum and steel-bodied coal cars, including triple hopper, hybrid aluminum/stainless steel hoppers and gondolas and flat bottom gondola railcars. The Company has established a licensing arrangement with a railcar manufacturer in Brazil pursuant to which its technology is used to produce various types of railcars in Brazil. In addition, it manufacture coal car! s for exp! ort to Latin America and have manufactured intermodal railcars for export to the Middle East. Railroads outside of North America have a range of track gauges that are sized differently than in North America, which requires it, in some cases, to alter manufacturing specifications for foreign sales. The Company has added 10 new or redesigned products to its portfolio in the last five years, including the AVC, slab and coil steel railcar, triple hopper and hybrid aluminum/stainless steel railcars, ore cars, ballast cars and aggregate cars. The Company�� manufacturing process involves four basic steps: fabrication, assembly, finishing and inspection. In its fabrication processes, it employ standard metal working tools, many of which are computer controlled. Each assembly line typically involves 15 to 20 manufacturing positions, depending on the complexity of the particular railcar design.     I went out on a limb last week, and now it's time to see how that decision played out.

    I predicted that Titan Machinery (NASDAQ: TITN  ) would close lower on the week. The specialty retailer of agricultural and construction equipment has been disappointing on the bottom line in recent quarters, and analysts were expecting Titan to post its first quarterly deficit since going public six years ago come Thursday. It did. The stock declined 0.5% on the week. I was right. I predicted that the tech-heavy Nasdaq would outperform the Dow Jones Industrial Average. (DJINDICES: ^DJI  ) . This has been a tricky call lately, so how did it play out this time? Well, the market saved itself by rallying on Friday. The Nasdaq moved 0.4% higher on the week. The Dow managed to close 0.9% lower. I was wrong. My final call was for Francesca's Holdings (NASDAQ: FRAN  ) to beat Wall Street's income estimates in its latest quarter. The rapidly expanding boutique operator has been posting blowout quarterly results over the past year, and I was banking on seeing the trend continue. Analysts were looking for a profit of $0.26 a share during the quarter, and it merely matched that target. That was close, but not what I had predicted. I was wrong.

    One out of three? Bummer! I was an impressive 16 out of 18 over the six previous weeks.

What may matter more than First Solar's progress in thin film is how quickly crystalline silicon modules are able to increase efficiency over the same time frame.     Dover (DOV) is another stock that's in a solid uptrend this fall. Like BSX, the manufacturing conglomerate has been trending higher since the start of the summer – beating the S&P 500 on a relative strength basis all the way up.

    And just like BSX, the ideal time to buy comes on a bounce off of trendline support.

    DOV pushed higher off of support in yesterday's session, catching a bid before it got down to the 50-day moving average. At this point, Dover's bounce is still a little tentative. While buyers did step in and bid shares up, yesterday's price action left things close to the support line. So while now might be a good time to build a starter position in DOV, I'd recommend waiting for a more confirmed more off of support before putting cash on this trade.

    If you decide to jump in here, keep a tight protective stop in place.
