Advisors' Opinion:- [By Patricio Kehoe]
When Diageo CEO Ivan Menezes declared last quarter that the company would not be buying Beam Inc. (BEAM) in order to boost its bourbon and tequila portfolio, it became clear that the firm was well off as it is. And I applaud management decision to hold back, because this firm unmatched spirit portfolio combined with its vast distribution network make it a solid global market leader. Although the company operates in 180 countries, its particularly strong position in the U.S. market is highly beneficial, as this is the most profitable spirits market worldwide. The distribution, handled by 2,800 exclusive salespeople that only attend the company namesake brands, is highly profitable, resulting in domestic operating margins of almost 40%. Also, these distributor relationships cover 80% of the company U.S. volume, making for a business model that would be very difficult for new market entrants to duplicate.

Action to take --> Ackman's activist campaigns appear to have run their course for a number of his top holdings, including Canadian Pacific, General Growth and Beam (NYSE: BEAM). For investors looking to invest in stocks that could still benefit from Ackman's activist expertise, I would consider Air Products and Procter & Gamble. Ackman appears to be sticking with what he knows; one of his biggest wins of late was at Canadian Pacific, an industrial stock, and so it's no surprise his newest campaign is at yet another industrial company, Air Products. Both P&G and Air Products should also be big benefactors of a rebounding economy. If you really want to invest like Ackman, be on the lookout for next year's planned IPO of Pershing Square Holdings, which will allow investors to invest in Ackman's hedge fund through a shell company.

One concern that Brown-Forman might not need to worry about at least for now is the prospect of further consolidation in the space. For a while, it appeared that Diageo might move forward to try to buy out Brown-Forman whiskey rival Beam (NYSE: BEAM ) . But Diageo CEO Ivan Menezes dismissed talk of a merger, saying it was unnecessary in light of Diageo's already-strong Johnnie Walker brand and other offerings. As for Constellation Brands, its recent move to pick up the Grupo Modelo U.S. beer business has likely left it needing some time before considering any further major corporate moves in the near future.

What: Shares of Dyax (NASDAQ: DYAX ) lost 34% of their value today, falling off a cliff after first-quarter earnings came out.
So what: First-quarter net sales increased slightly from a year ago, to $12.0 million, but analysts expected $16.0 million in revenue, so this is a huge miss. It's no wonder that net loss of $11.2 million equates to $0.11 per share, more than double the $0.05 per share loss analysts expected.
